SIOUX FALLS, S.D. (AP) — Lawyers for a Florida man charged in the 1989 slaying of his then-girlfriend in South Dakota are asking a judge to dismiss the case.

Fifty-seven-year-old Kim Aune is accused of shooting his 21-year-old girlfriend, Kimberly Eidsness, 26 years ago at their home east of Sioux Falls. He was indicted this past April on first-degree murder charges in South Dakota, then arrested in Florida.

Authorities haven't said what new details led them to reopen the case.

The Argus Leader reports that Aune's lawyers filed a motion to dismiss the indictment against him on Nov. 3. Details on their reasoning have been sealed to the public.

Aune is from Florida's Lee County. His trial in South Dakota is scheduled to begin Jan. 10.
